Data sexto kalendas Julii, Adelfio viro clarissimo consule.
[…] received from the apostles and preached, you will not allow to be handled again as if doubtful; and that you will not permit what was once condemned by the authority of our elders to be stirred up by revived attempts; and that you will rather command that the decrees of the ancient Nicene synod remain, with the heretics' interpretation set aside. Nor, as your clemency wished, should you believe me to be absent from that council, since in these brethren whom I have sent, that is, Paschasinus and Lucentius the bishops and Boniface and Basil the presbyters, and also in my brother Julian, whom I wished to be their partner, my presence too is to be reckoned. I trust that they, with Christ's help, will so act that those things which please our Lord may be decreed, with the added zeal of your piety, which may benefit peace, and religion, and the safekeeping of the truth. Given on the sixth day before the Kalends of July, in the consulship of Adelfius, a man most illustrious.

The Vienna Hispana: Paschasino episcopis, where, because of the plural episcopis, Lucentius is recognized to have been left out by a skip of the copyist's eye. Tomo IV Concilior. editionis Venetae pag. 837 exstant Graecae Marciani litterae Anatolio inscriptae, quibus invitatur ad synodum. In mss. autem Graecis bibliothecae Caesareae apud Lambecium tom. VIII, pag. 495, eaedem litterae inscribuntur, Λέοντι και Ανατολιω Leoni et Anatalio. Antiqua earumdem litterarum versio pag. 1985 tom. IV. Junias, in Latinis vero exemplaribus collect. 5 Quesnellianae, et Rustici X kal. Junias; concilio autem Nicaeae habendo, uti tum indictum fuit, praestituitur dies kal. Septembris.

In vol. IV of the Councils, Venice edition, p. 837, there survives Marcian's letter in Greek addressed to Anatolius, by which he is invited to the synod. In the Greek manuscripts of the Imperial Library, however, in Lambeck, vol. VIII, p. 495, the same letter is inscribed Λέοντι και Ανατολιω, "To Leo and Anatolius". An ancient version of the same letter, p. 1985, vol. IV of the Councils, presents it as a general encyclical, with the title: "Sacred letter of the same most pious emperors to the most God-loving bishops everywhere." But since in the letter itself it is said of Leo, "As the letter of the most religious bishop of the glorious city of Rome also shows", words which in a letter to this pontiff ought either to have been omitted or put otherwise, if a like copy was sent to Leo without any letter of its own accompanying it, we may not therefore affirm that we have the very letter to him. This letter, moreover, is presented as dated, in the Greek, XVI kal. Junias, but in the Latin copies of Quesnel's collection 5 and of Rusticus, X kal. Junias; and for the council to be held at Nicaea, as it was then summoned, the day appointed is the Kalends of September.

Data sexto kalendas Julii, Adelfio viro clarissimo consule.
[…] synod so narrow a time was set, since even if no necessity arising from hostilities existed, the very fewness of the intervening days would not allow us to summon the necessary priests. For when could we send through the various and distant provinces, so that a council might truly be made universal? But because we embrace the will of the most clement prince with such affection that we have been unwilling to oppose this arrangement of his, especially since you yourself also ask this of us with great desire, we have had our brother and fellow bishop PASCHASINUS, a man approved by us, sail from a safer province; to whom we have joined our brother and fellow presbyter BONIFACE from the City, associating with them also those who had previously been appointed, so that, with our brother and fellow bishop JULIAN, whose faith we have often proved, taking part in all the proceedings, they may act in our stead in the coming council. For we do not believe that there will have to be any labour there over the difficulties of disputes, since you yourself have also deigned to indicate that in receiving the catholic faith and in the condemnation of Eutyches and Nestorius all the eastern priests have subscribed. Given on the sixth day before the kalends of July, Adelfius, a man of clarissimus rank, being consul.

Data sexto kalendas Julii, Adelfio viro clarissimo consule.
What we judge of the mind of your affection you have often recognized: for very many things have gone before which would make us presume these things. Hence, since for this reason, according to the will of the most Christian prince, a synod of priests is to be held in the city of Nicaea, so that the din of all scandals may be taken away, we of necessity enjoin on your brotherliness what may profit the whole Church: that with our brothers and fellow bishops Paschasinus and Lucentius, and also with our brothers and fellow presbyters Boniface and Basil, whom we have ordered to go in our stead to the aforesaid assembly, you join your care and action in all things, making use of the authority of our command; since we know that you have a greater knowledge than our people of all the things done there: so that, while you associate your care and counsel with them, they may be deceived in no part; but that all things, God helping, which you find to befit the faith and peace may come to effect.

He says "truly", since a council truly, or properly, universal requires that bishops be summoned from the whole catholic world. Nonetheless the councils of Chalcedon and the first of Ephesus were held to be ecumenical, although a time suitable for a general summons of this kind was lacking. This must be ascribed to the approval of the apostolic see; indeed the first council of Constantinople, which was held without the knowledge of the Roman pontiff himself, began to be reckoned among the general councils after [that see] at length received it.

Exstat in mss. collect. 5 Hisp. Isid. 11, 12, 13, et 18 usque ad 24, nec non in exemplo Sichardi, et in peculiari ms. Vat. 1322. Eamdem vero invenius in duobus mss. Graecis Venetis S. Marci 164 ei 555, tum inter epistolas ante gesta, uti a Romanis editoribus inventa fuit, tum insertam ipsi consilio (quemadmodum in excerptis Theodori lectoris describebatur) et in eo recitatam actione 16 hactenus inedita, quae in appendice publicabitur.

It is extant in the mss. of collection 5, the Spanish, the Isidorian, 11, 12, 13, and 18 to 24, and also in Sichard's copy, and in the separate ms. Vat. 1322. In collection 18, of Chalcedon, the Greek codices display it, but not the Latin: which is an indication that the Greek codex which the Latin translator used lacked this letter. It was edited in Greek among the letters before the acts. We have found it, moreover, in two Greek mss. of Venice, of St Mark, 164 and 555, both among the letters before the acts, as it was found by the Roman editors, and inserted in the council itself (as was described in the excerpts of Theodore the Lector) and read out in it in the 16th session, hitherto unedited, which will be published in the appendix.

In tabula collect. 5, cap.

In the table of collection 5, chapter 92, thus: To the synod of Chalcedon, on restoring to their own sees the bishops who had formerly been driven out for the catholic faith, and on the firmness of the earlier synod of Ephesus. In the Spanish collection thus: To the synod of Chalcedon, in which he exhorts the priests of God through his legates to arrange all things according to the Scriptures.

(k) ‹S. SYNODO› · printed under col 936

So [we read] from the Ratisbon [codex], and more truly indeed than elsewhere, apud Chalcedonam. For when Leo issued this letter, the synod had been summoned to Nicaea, not to Chalcedon. Theodore the Lector in the Excerpts testifies that Leo wrote a wonderful letter to the Synod which was believed to be about to assemble at Nicaea; and likewise Evagrius, whom Quesnel cited in note 1. Only, when, the place of the council having afterwards been changed, this very letter was read at Chalcedon in the unedited 16th session, the name of the city was changed so that the inscription might suit that same synod; and for this reason this letter in the praised Greek codices of St Mark displays Nicaea before the acts, but Chalcedon in session 16. From this the Latin codices too were emended, since the council was in truth held not at Nicaea but at Chalcedon. The words urbis Romae, placed under the word episcopus in the printed editions, we have deleted, since they are omitted in our better codices and in the ancient Greek version. On the other hand, we have added the words dilectissimis fratribus in Domino salutem from the Vienna [codex] of collection 5 and the Florentine of St Mark of collection 13, since they are found in the same Greek version.

But because many things often happen which can produce repentance, and the mercy of God overcomes the faults of those who offend, and therefore punishment is suspended so that correction may have room, the counsel of the most clement prince, full of religion, must be embraced, by which he has willed your holy brotherhood to assemble to destroy the snares of the devil and to restore the peace of the Church, the right and honour of the most blessed apostle Peter being preserved, so much so that he invited us too by his letters to this, that we should afford our presence to the venerable synod; which indeed neither the necessity of the time nor any custom could permit.

21, vestri.

So five codices of Quesnel and eleven of ours. The printed editions of Leo before Quesnel, with one codex of collection 21: vestri.

(b) ‹fidei devotione› · printed under col 937

Ratisp., consistere. Mox pro potestatum Vat. Hisp. et Isid. ac alius Vat. collect. 11 habent sacerdotum. Utrumque omittit Ratramnus lib. IV contra Graecos tom. I Spicileg. Acher., pag. 110.

Ratisbon: consistere. Shortly after, for potestatum the Vatican Spanish and Isidorian and another Vatican of collection 11 have sacerdotum. Ratramnus omits both, book IV against the Greeks, vol. I of d'Achery's Spicilegium, p. 110.

(c) ‹saecularium depravari› · printed under col 937

Laudati codd. tres cum Ratramno, aut a via veritatis abscedere. Dein in iisdem mss. et in Vind. Hisp. deest saepe.

The three codices cited, with Ratramnus: aut a via veritatis abscedere. Then in the same mss. and in the Vienna Spanish saepe is lacking.

(d) ‹ecclesiasticam pacem› · printed under col 937

Idem codices tres maluit. Post pauca Ratisp. et Vat. collect. 24 omittunt apostoli.

The same three codices: maluit. A little after, the Ratisbon and the Vatican of collection 24 omit apostoli. Then in the same Ratisbon: honore reservato; and shortly after: ut et venerabili.

(e) ‹nec ulla› · printed under col 937

Ms. Vindebon. collect. 5, potuit. Hanc eamdem rationem, ne ad Ephesinum concilium proficisceretur, Leo allegavit in epist. 31, c. 4, et similiter Paschasinus in Chalcedonensi act. 3, t.

The Vienna ms. of collection 5: potuit. Leo alleged this same reason for not going to the council of Ephesus in letter 31, ch. 4, and likewise Paschasinus at Chalcedon, session 3, vol. IV, p. 1250: "Since," he says, "neither did ancient custom hold this, nor did the general necessity of the time seem to permit it."

The words hoc est we have added from the very ancient Vat. 1322, the Vienna [codex] of collection 5, the Vatican Spanish Isidorian and Ratramnus, the Greek version agreeing. The Ratisbon has id est; and shortly after, with the Vienna [codex] of collection 5, it displays Lucensi for Lucentio.

(g) ‹synodo vestra fraternitas› · printed under col 937

Codices Vat. 1322, Ratisp. et Grim., vestra sanctitas.

The codices Vat. 1322, Ratisbon and Grimani: vestra sanctitas.

(h) ‹praesidere, non abjuncta› · printed under col 937

Ita potiores nostri et Quesnelli codices. Vat.

So the better codices of ours and of Quesnel. The Vatican Spanish and Isidorian: non sejunctam a vobis praesentiam meam; to which words in the mss. of collection 21 aestimet is added, and before it confidat is found for aestimet. In the older editions of Leo, however: nec sejunctam a vobis praesentiam meam confidat.

(i) ‹jamdudum in› · printed under col 937

The preposition in, which the editions of Leo pass over, we have added from Vat. 1322, the Vienna Spanish and another Vatican of collection 11, together with the printed editions of the councils.

(j) ‹non desum: ut qui› · printed under col 937, running on under col 938

Vat.

The Vatican Spanish and Isidorian: et qui; and shortly after, for non possitis, they have, with the Vienna Spanish, non potestis. Then quid cupiam is in the Vienna [codex] of collection 5, in another Spanish, in the Ratisbon, in the Vatican of collection 24 and in Sichard.

(k) ‹secundum evangelicas› · printed under col 938

Ratisp., evangelicam auctoritatem, cui lectioni Graeca versio astipulatur.

Ratisbon: evangelicam auctoritatem, a reading with which the Greek version agrees.

Note (j) ends under this column ("quid cupiam … apud Sichardum."), and (k) is printed here; both answer calls in col 937: set in n937. 1 ‹κατὰ τὴν προσοῦσαν διάθεσιν› (Greek version) · printed under col 938 Mss. Ven., σχέσιν.

The Venetian mss.: σχέσιν.

2 ‹ἐν ἑνὶ ζήλῳ› · printed under col 938 Mss. Ven., ἐνὶ ζήλῳ.

The Venetian mss.: ἐνὶ ζήλῳ.

3 ‹χώραν σχεῖν› · printed under col 938 Codd. Ven., χάραν ἔχειν.

The Venetian codices: χάραν ἔχειν.

4 ‹τῶν ἐπιβουλῶν› · printed under col 938 Mss.

The Venetian mss.: τοῦ ἐπιβουλεύοντος διαβολου, τὴν δέ τῆς ἐκκλησιαστικῆς, etc.

5 ‹φυλαττομένων› · printed under col 938 Mss.

6 ‹ὡς καὶ ἡμᾶς› · printed under col 938 Codd.

The same codices: τὴν ἑαντῶν παρονσίαυ παρασχεῖν ἡδέως τῇ ἁγίᾳ ονιόδῳ [misprinted for τὴν ἑαυτῶν παρουσίαν …

8 ‹οὐκ ἠδύνατο› · printed under col 938 Codd.

9 ‹τουτέστι Πασχασίνῳ› · printed under col 938 Ita scribimus e duob. mss. Ven. Rom. edit. notatum invenies.

So we write from two Venetian mss. In the printed editions: τουτέστιν ἐν Πασχασίνῳ, which does not please. But for Πασχασίῳ one of the codices cited above has, before the acts, Πασχασίνῳ; which you will also find noted in the margin of the Roman edition.

10 ‹ὑπὸ τοῦ θρόνου› · printed under col 938 Codd. Ven., παρὰ τοῦ θρόνου.

The Venetian codices: παρὰ τοῦ θρόνου.

11 ‹μὴ κεχωρισμένης› · printed under col 938 Ita correximus e duobus mss. Ven. suffragante Latino textu, non abjuncta, a vobis praesentia mea. In vulg., μὴ κεχωρισμένων ὑμῶν, etc. In marg. tamen edit. Rom. annotatum videtur κεχωρισμένης. L.

So we have corrected from two Venetian mss., the Latin text supporting it: non abjuncta, a vobis praesentia mea. In the printed editions: μὴ κεχωρισμένων ὑμῶν, etc. In the margin of the Roman edition, however, κεχωρισμένης seems to be noted. L.

12 ‹ὑμᾶς τοὺς› · printed under col 938 Adjecimus articulum τοὺς, qui deest, sed male, in vulgatis, auctoritate codd.

We have added the article τοὺς, which is lacking, but wrongly, in the printed editions, on the authority of the Venetian codices, both of which indeed have in the acts ὡς καὶ ὑμᾶς τούς ἀγνοεῖν μὴ δυναμένους, but before the acts only one, ὡς ὑμᾶς τοῦ ἀγνοεῖν, etc., so that one may see that τοῦ is an error for τούς. That the clarity of the sentence is helped not a little by adding this article will be plain to anyone who pays attention.

13 ‹ἀμφιβάλλειν› · printed under col 938 Codd.

[…] words, and the apostolic doctrine, it has been declared most fully and most clearly, through the letter which we sent to Bishop Flavian of blessed memory, what is the pious and sincere confession concerning the sacrament of the incarnation of our Lord Jesus Christ.
CAP. III.
CHAP. III. — But since we are not unaware that through perverse rivalries the state of many Churches has been disturbed, and that very many bishops, because they would not receive the heresy, have been driven from their sees and deported into exile, and others put in the place of those still living: let the medicine of justice be applied first of all to these wounds, and let no one be so deprived of his own that another may use what is not his: since, if, as we desire, all abandon the error, no one ought indeed to lose his own honour; but for those who have laboured for the faith their own right, with all its privilege, must be restored.
Prioris autem Ephesinae synodi, cui sanctae memoriae Cyrillus episcopus tunc praesedit, contra Nestorium specialiter statuta permaneant: ne tunc damnata impietas ideo sibi in aliquo blandiatur, quia Eutyches justa exsecratione percellitur. Bene valete in Domino, fratres charissimi. Data sexto kalendas Julii, Adelfio viro clarissimo consule.
But let the decrees of the former synod of Ephesus, over which Bishop Cyril of holy memory then presided, made specifically against Nestorius, remain in force: lest the impiety condemned then should flatter itself in any respect because Eutyches is struck down by a just execration. For the purity of faith and doctrine, which we preach in the same spirit as our holy Fathers, condemns and pursues alike both the Nestorian and the Eutychian perversity together with their authors. Farewell in the Lord, dearest brothers. Given on the sixth day before the kalends of July, Adelfius, a man of clarissimus rank, being consul.

(a) ‹turbatum, plurimosque› · printed under col 939

Cum in Vindebon. Hisp. perperam legatur, plurimosque spiritus, in Vat. Dein expulsos in cod. Ratisp.

Since in the Vienna Spanish plurimosque spiritus is wrongly read, in the Vatican Spanish, and from it in the Isidorian, it was corrected at the discretion of an ancient copyist to plurimosque fratres. Shortly after, Ratramnus and the mss. of collection 21, with the editions before Quesnel: receperunt, or receperint. Then expulsos in the Ratisbon codex.

(b) ‹vulneribus adhibeatur› · printed under col 939

So eleven of our codices, with Ratramnus and the editions earlier than Quesnel, who, with only our Vienna [codex] of collection 5, preferred adhibenda est medicina.

(c) ‹justitiae, nec quisquam› · printed under col 939

Antiquam pariter lectionem ex nostris codicibus revocavimus. Solum Vat. 1322, ne quisquam, omisso ita. Vindebon. collect. 5, ne quisquam ita, etc. Vindebon.

Likewise we have recalled the ancient reading from our codices. Only Vat. 1322 has ne quisquam, ita being omitted. The Vienna [codex] of collection 5: ne quisquam ita, etc. The Vienna Spanish deletes only ita. Nowhere, however, have we found Quesnel's reading, nec quisquam careat propriis, aut alter utatur alienis.

(d) ‹omnes relinquunt› · printed under col 939

Cod. Ratisp., relinquant. Mox, apud neminem in Vindebon. collect. 5. Dein Vulgati antiquiores cum mss. collect. 21 et 24 omittunt suus, et postea suo. Quesnellus inseruit suus, uti legitur etiam in nostris codd. Vat. 1322. Vindebon. collect. 5 et Vat. Hisp. ac Isid. Nos autem inseruimus quoque suo post vocem privilegio auctoritate laudati Vat. 1322. Vindebon. collect. 5, alterius Hisp. et Vat. collect. 11 ac praestantissimi Ratisp.

The Ratisbon codex: relinquant. Shortly after, apud neminem in the Vienna [codex] of collection 5. Then the older printed editions, with the mss. of collections 21 and 24, omit suus, and afterwards suo. Quesnel inserted suus, as it is also read in our codices Vat. 1322, the Vienna of collection 5 and the Vatican Spanish and Isidorian. We, moreover, have also inserted suo after the word privilegio, on the authority of the cited Vat. 1322, the Vienna of collection 5, the other Spanish, and the Vatican of collection 11, and the most excellent Ratisbon.

(e) ‹Cyrillus episcopus› · printed under col 939

Vide not. 2 Quesnelli. Notandum vero est S. Cyrillum in Ephesinis gestis se Coelestini papae vicem gerentem semper praeferre, quippe cui apostolicae sedis auctoritatem in Nestorii causa idem pontifex delegaverat.

See Quesnel's note 2. It should be noted, however, that St Cyril in the acts of Ephesus always presents himself as acting in the stead of Pope Celestine, since the same pontiff had delegated to him the authority of the apostolic see in the case of Nestorius.

(f) ‹impietas ideo› · printed under col 939

Vindebon. Hisp., idem sibi. Hic error emendatus in Vat.

The Vienna Spanish: idem sibi. This error was emended in the Vatican Spanish, and from it in the Isidorian, and in the mss. of collections 11 and 21, and in Ratramnus: demum sibi in aliquo blandiatur, qua Eutyches.

(g) ‹fidei atque› · printed under col 939

Vat. Hisp. et Isid., doctrina.

The Vatican Spanish and Isidorian: doctrina.

(h) ‹pravitatem. Bene valete› · printed under col 939, running on under col 940

The six words Bene valete in Domino, fratres charissimi are missing in the editions of Leo; they are read, however, in the printed Councils, and we have recalled them not only because they are in the Vienna [codex] of collection 5 and in the Florentine of St Mark of collection 13, but also in the very ancient Greek translation, which was taken from Leo's original itself and was read at the council of Chalcedon in session 16.

(i) ‹Data sexto› · printed under col 940

Codices Vindebon. collect. 5 et Florentinus S. Marci collect. 13, v kal. 11 (932, n. e) in epist. 89. Praetulimus diem VI kal.

All the printed editions, with the mss. of collection 24: v. kal. Julii; a reading which the Greek text also supports, both in the printed editions and in our ms. books of the collection of Chalcedon before the acts. The codices Vienna of collection 5 and the Florentine of St Mark of collection 13: v kal. Junias, a certain error in the month, as is plain from annotation 11 (932, n. e) on letter 89. We have preferred the day VI kal. Julii, which agrees with the preceding letters, on the authority of Vat. 1322, both Spanish, the Isidorian, the Ratisbon and the codices of collections 11 and 21.

The Venetian mss.: εἰς τόπον. We change nothing, although the Latin text has in locum.

6 ‹τοῖς ἄλλου› (the call is printed like a 5) · printed under col 940 Ita et bene, mss. Ven. ambo tam in gestis quam ante gesta. Male in Vulg., τοῖς ἄλλοις.

So, and rightly, both Venetian mss., both in the acts and before the acts. Wrongly in the printed editions: τοῖς ἄλλοις. For this word ἄλλον never signified nor signifies what alius does.

7 ‹παραπολεῖσθαι› · printed under col 940 Mss.

8 ‹μετὰ τῶν προνομίων› · printed under col 940 In marg. edit.

In the margin of the Roman edition:

9 ‹τότε προήδρευε› · printed under col 940 Addimus τότε, quod aberat a vulgatis, auctoritate codd.

We add τότε, which was absent from the printed editions, on the authority of the Venetian codices and also of the Latin text, in which tunc praesedit is read. For the rest, in the aforesaid codices this whole passage is represented thus: Καὶ μέντοι γε τῆς προτέρας ἐν Ἐφέσῳ συνόδου, ἧς τινος ὁ τῆς ὁσίας μνήμης Κύριλλος τότε προέδρευε, κατὰ Νεστορίου ἰδικως τὰ συνοδικῶς πραχθέντα διαμενέτωσαν.

In vulg., ἢ τῷ ἁγίῳ Πνεύματι. Admonemus tamen paulo post ᾧπερ legendum esse pro ὥσπερ.

So we emend, following the reading of the Venetian codices, which answers exactly to the Latin text, eodem quo sancti Patres nostri spiritu. In the printed editions: ἢ τῷ ἁγίῳ Πνεύματι. We point out, however, that a little after ᾧπερ should be read for ὥσπερ.
